This Return and Refund Policy applies to all purchases made through the FUNCO online store operated by:

1. General information
FUNCO sells apparel and related products manufactured individually after an order is placed. Most products available on our website are produced through a made-to-order and print-on-demand manufacturing process.
By placing an order, the Customer acknowledges and agrees that the products purchased are manufactured specifically for that order and are not pre-produced inventory items.
2. Right of withdrawal and legal exception
Under Directive 2011/83/EU on Consumer Rights, as implemented in Romania through Government Emergency Ordinance No. 34/2014, consumers generally have the right to withdraw from a distance contract within fourteen (14) calendar days without providing any reason.
However, Article 16(c) of Directive 2011/83/EU and Article 16(c) of Romanian Government Emergency Ordinance No. 34/2014 provide a specific exception for:
"the supply of goods made to the consumer's specifications or clearly personalized."
Because the vast majority of products sold by FUNCO are manufactured individually according to the Customer's selected model, size, color, design, print configuration, and other specifications, such products fall within this legal exception.
Accordingly, the statutory 14-day withdrawal right does not apply to products manufactured specifically for an individual order.
Once production has commenced, the order cannot be cancelled solely because the Customer changes their mind, selects an incorrect size, no longer wants the product, or places the order by mistake.
3. Size selection and customer responsibility
Customers are solely responsible for selecting the correct size before placing an order.
Detailed size charts are available on each product page and should be carefully reviewed before completing the purchase.
A sizing issue resulting from an incorrect size selected by the Customer does not constitute a manufacturing defect, non-conformity, or delivery error and therefore does not qualify for a return, replacement, refund, or exchange.
Minor variations in dimensions within reasonable manufacturing tolerances shall not be considered defects.
4. Situations in which claims are accepted
FUNCO will review and process claims in the following situations:
a) the product contains manufacturing defects;
b) the product contains printing defects;
c) the print is significantly different from the approved design displayed on the website;
d) the wrong product, color, size, or design was delivered;
e) the product was damaged during transportation;
f) the product does not conform to the order confirmation due to an error attributable to FUNCO or its production partners.
Where appropriate, FUNCO may:

replace the product;

reproduce and resend the product;

issue a partial refund;
-
issue a full refund.
The remedy offered shall be determined by FUNCO based on the nature of the claim and applicable consumer protection legislation.
5. Notification of defects
To enable an efficient investigation, Customers must notify FUNCO as soon as reasonably possible after receiving the order.
We strongly recommend reporting any defect, damage, or delivery error within forty-eight (48) hours from delivery.
Claims should be submitted by email to:

photographs showing the alleged defect or damage;

photographs of packaging where relevant.
Failure to provide sufficient evidence may result in the claim being rejected.
6. Inspection and verification
FUNCO reserves the right to investigate any claim before approving a replacement or refund.
Where fraud, misuse, intentional damage, abnormal use, improper washing, improper storage, unauthorized modifications, or other customer-caused issues are identified, the claim may be rejected.
FUNCO may request additional information, photographs, or documentation necessary to verify the claim.
7. Products that are not eligible for refunds or replacements
Refunds, exchanges, or replacements will not be granted in the following situations:

the Customer selected the wrong size;

the Customer selected the wrong color or variant;
-
the Customer changed their mind after placing the order;
-
the Customer no longer wants the product;
-
the product has been worn, washed, altered, damaged, or improperly maintained;
-
minor differences in color resulting from monitor, mobile device, printer, lighting, or display settings;
-
minor manufacturing variations that do not affect the normal use of the product;
-
claims submitted without sufficient supporting evidence.
8. Return shipping
If a claim is approved and the return of the product is required, FUNCO will provide instructions regarding the return process.
Where the defect or non-conformity is confirmed, FUNCO shall bear the reasonable return shipping costs.
Unauthorized returns sent without prior approval may be refused.
9. Refund processing
Where a refund is approved, it shall be issued using the same payment method originally used by the Customer unless otherwise agreed.
Refunds are generally processed within fourteen (14) calendar days after:

approval of the claim; and

receipt of all information reasonably required to process the refund.
Banking institutions and payment providers may require additional processing time beyond FUNCO's control.
10. Consumer statutory rights
Nothing in this Return and Refund Policy limits, excludes, or affects any mandatory consumer rights granted under applicable European Union legislation, Romanian consumer protection laws, or legal guarantees of conformity.
Customers remain entitled to all statutory remedies available under applicable law in cases involving defective, damaged, non-conforming, or incorrectly delivered products.
11. Abuse prevention
FUNCO reserves the right to refuse claims that are fraudulent, abusive, submitted in bad faith, or inconsistent with the evidence provided.
Repeated unjustified claims, attempts to obtain products without payment, false defect reports, intentional damage, or other forms of abuse may result in refusal of future orders and the exercise of any legal remedies available to FUNCO.
